(C)  Foreign Convictions.  Reliance upon a foreign conviction to enhance sentence requires resentencing where (a) the foreign conviction failed to meet standards of fundamental fairness; (b) the court erroneously believed it valid; and (c) the court relied upon it to enhance the sentence.[409]

 


[409] United States v. Moskovits, 784 F. Supp. 193, 197 (E.D. Pa. 1992) (errors in prior conviction rendered in Mexico and relied upon by the sentencing court required a new sentence); see United States v. Fleishman, 684 F.2d 1329, 1346 (9th Cir.), cert. denied, 459 U.S. 1044 (1982).

United States v. Rodriguez-Gonzalez, __ F.3d __ (9th Cir. Feb. 19, 2004) (Almendarez-Torres v. United States, 523 U.S. 224 (1998) (prior offense may be used to increase sentence even if omitted in Government pleading), does not apply when the earlier offense operated not merely to increase defendant's sentence, but to transform his second offense from misdemeanor to felony).
