§ 7.81 d. Failure to Correct Error of Fact or Law

Counsel renders ineffective assistance when s/he fails to correct errors in the probation report or in the prosecutor's statements at sentence.[259]  Failure to ensure that the “factual basis for the sentence will be both adequate and accurate, and that the record of the sentencing proceedings will accurately reflect relevant circumstances of the offense and characteristics of the defendant which were not disclosed during the guilt phase of the case . . . .”[260]
