§ 7.15 C. Length of Actual Confinement

            The actual length of confinement, as opposed to the formal sentence imposed discussed above, has several immigration effects.  First, a noncitizen is disqualified from obtaining a waiver of deportation under former INA § 212(c) if s/he actually served five years or more in custody for one or more aggravated felony convictions.  See § 7.16, infra.  Second, a noncitizen is disqualified from showing Good Moral Character, which is required to obtain a number of different immigration benefits, if s/he has actually served 180 days or more in custody as a result of one or more criminal convictions of any type at all.  See § 7.17, infra.
