If the offense could be either a felony or a misdemeanor, a motion to reduce it from a felony to a misdemeanor changes the maximum sentence to one year or less.  This reduction has been held to change the conviction into one with a one-year maximum and thus to qualify for the third requirement of the Petty Offense Exception.[138]
