The prosecution has a duty of fairness, and must be motivated by a desire to see justice done, rather than a desire to see the greatest possible sentence imposed.[377]  A prejudicial violation of the prosecution’s duties at sentence can result in a violation of due process, requiring that the sentence be vacated.
