The following offenses constitute aggravated felonies only if custody of one year or more was ordered by the sentencing court.[15]

 

·  Accessory after the fact (8 U.S.C. § 1101(a)(43)(S))

·  Bribery of a witness (8 U.S.C. § 1101(a)(43)(S))

·  Burglary (8 U.S.C. § 1101(a)(43)(G))

·  Commercial bribery (8 U.S.C. § 1101(a)(43)(R))

·  Counterfeiting (8 U.S.C. § 1101(a)(43)(R))

·  Crimes of violence (8 U.S.C. § 1101(a)(43)(F))[16]

·  Document fraud (8 U.S.C. § 1101(a)(43)(P))

·  Forgery (8 U.S.C. § 1101(a)(43)(R))

·  Obstruction of justice (8 U.S.C. § 1101(a)(43)(S))

·  Perjury (8 U.S.C. § 1101(a)(43)(S))

·  Receipt of stolen property (8 U.S.C.

§ 1101(a)(43)(G))

·  Subornation of perjury (8 U.S.C. § 1101(a)(43)(S))

·  Theft (8 U.S.C. § 1101(a)(43)(G))

·  Trafficking in vehicles with altered identification numbers (8 U.S.C. § 1101(a)(43)(R))

 

The other aggravated felonies are aggravated felonies regardless of sentence.

SENTENCE - SENTENCE IMPOSED - 12 MONTHS EQUALS ONE YEAR
12 months equals one year in immigration court. See Drakes v. Zimski, 240 F.3d 246, 251 (3d Cir. 2001); United States v. Christopher, 239 F.3d 1191, 1193 (11th Cir. 2001).
