§ 7.85 a. Moral Turpitude Offenses

A person is eligible for the Petty Offense Exception to the moral turpitude ground of inadmissibility only if the sentence imposed was six months or less.  Counsel should have obtained suspended imposition of sentence or a sentence of six months or less.

            A person is deportable if convicted within five years of last admission of one moral turpitude offense with a maximum sentence of one year or more.  Counsel should have obtained a plea to an offense with a maximum of 364 days or less, or obtained a reduction of the level of the offense to a misdemeanor with a maximum of less than one year.
