§ 7.62 G. Motion to Modify Probationary Sentence

In many jurisdictions, the defendant may make a motion to modify the conditions of probation at any time during the period of probation.  See § 7.63, infra.  Thus, the defendant may seek to vacate a probation condition imposing a certain sentence (for example, 365 days in local custody), and agree to a different condition (for example, 364 days in local custody).  There is no reason why this cannot be done at any time during the probationary period, even if the custodial sentence originally imposed has already been completely served.  This modification would have the effect of eliminating the original sentence completely for immigration purposes, and substituting the new sentence.  See § 7.53, supra.
