§ 7.101 2. Judicial Awareness of Discretion

Due process requires that a court impose sentence with awareness of the full scope of its discretionary sentencing choices.[319]  A sentence is reviewable for a claim that the court failed to exercise discretion or relied on improper or unreliable information.[320]
