§ 7.70 B. Relationship Between Grounds to Vacate Convictions and Grounds to Vacate Sentence

First, any ground of legal invalidity of the conviction will result in the elimination of the corresponding sentence as well, for immigration purposes.  See § 7.71, infra.  Second, many of the rights violations grounds on the basis of which a conviction can be vacated will also result in the invalidity of a sentence if the right is violated only at sentence.  See § 7.72, infra.  Third, the court must reaffirm the validity of the guilty plea at the time of the later imposition of sentence.  So if there has been a change in a fact upon which the validity of the plea depends, after plea but before sentence, that new fact will result in the invalidity of the sentence as well.  See § 7.73, infra.
