(A)  Failure to request downward departure based on noncitizen status.[272]


[272] Castro v. United States, ___ F.Supp.3d ___, 2003 WL 22909150 (S.D.N.Y. December 10, 2003) (claim of ineffective assistance of counsel based on counsel’s failure to request a downward departure based on voluntary agreement to be deported since (1) offense of conviction triggered automatic deportation, and (2) the “collateral consequences” of his “alienage” were “(1) the unavailability of preferred conditions of confinement, (2) the possibility of an additional period of detention pending deportation following the completion of sentence, [or] (3) the effect of deportation as banishment from the United States and separation from family . . . .”).
