(A)  As a Crime of Violence.  The BIA and some federal courts have found that statutory rape is a crime of violence, at least when the victim was a relatively young person, age 15 or younger.  Conviction of a crime of violence is an aggravated felony if a one-year sentence is imposed.  It does not have force as an element, and so does not constitute a “crime of violence” under 18 U.S.C. § 16(a).  Some courts, however, have held that having sex with a partner young enough is substantially likely to involve force in its commission under 18 U.S.C. § 16(b).
