§ 7.51 d. 18 U.S.C. 16(b)

The second part of the definition of the crime of violence aggravated felony for immigration purposes is set out at 18 U.S.C. § 16(b), and includes:

 

(b)       any other offense that is a felony and that, by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.[446]

 

This part of the crime of violence definition therefore includes the following essential elements:

 

            (1)       a felony conviction of an offense that, see § 7.52, infra,

            (2)       by its nature, see § 7.53, infra,

            (3)       involves a substantial risk, see § 7.54, infra,

            (4)       that physical force, see § 7.55, infra,

            (5)       against the person or property of another, see § 7.56, infra,

            (6)       may be used

            (7)       in the commission of the offense, see § 7.57, infra.

 

An offense or conviction, that lacks any of these essential elements is therefore a safe haven.
