(F)  Sentence Considerations.  All the techniques described under “Sentence,” § § 7.24-7.26, above, may be used in an effort to avoid a one-year sentence imposed, which will prevent the conviction from being considered an aggravated felony conviction under this theory.  Conviction of a misdemeanor rather than a felony will not prevent it from being an aggravated felony as burglary, if a one-year sentence is imposed.[351]  Burglary is not an aggravated felony under any theory unless a one-year sentence is imposed.
