(A) Elements of this Ground of Deportation. When war is declared between the United States and any foreign country or government, or any foreign nation or government threatens, attempts, or perpetrates any invasion of the United States, and the President makes a public proclamation of the event, all noncitizens who are citizens of a hostile nation or government, 14 years of age and older, who are in the United States, are liable to be removed as noncitizen enemies.[1421] This ground of deportation is not listed in the immigration act’s listing of grounds of deportation.[1422] NOTE: No conviction is required to establish this ground of deportation.
