(C)  Safe Havens for this Ground of Deportation.  The Ninth Circuit held that a noncitizen did not vote “in violation of any Federal, State, or local constitutional provision, statute, ordinance or regulation,â€[1378] because she did not have the requisite mental state to violate the Hawaii unlawful voting statute.[1379]  She was therefore not deportable under the unlawful voting conduct ground of deportation.[1380]  By listing only voting in violation of federal, state, or local law, Congress in effect excluded voting in violation of foreign law or voting in violation of the law of an Indian tribe.  See § § 7.16, 7.192, supra.
