(B)  Safe Havens Specific to this Category.  “Forgery” is the subject of dozens of different statutes, depending on the document forged.  The state statute of conviction should be compared with the federal aggravated felony definition of the term to determine whether they are coextensive.  If the state statute is broader than the federal aggravated felony definition of forgery, the state conviction will not fall within this ground of deportation if (a) the record of conviction identifies the state conviction as falling within the state, but not the federal, definition of the term, or (b) the record of conviction does not establish whether the state conviction falls within the aggravated felony portion of the state statute, since the government bears the burden of proof of every element necessary to establish deportability.  See § 5.24, supra.
