(F) Gratuitous Distribution of Small Amount of Marijuana or Hashish. A first conviction of gratuitous distribution of a small amount of marijuana or hashish will also be considered a safe haven if the state court declares it to be a misdemeanor. This is because federal law provides that this offense must be treated as though it were simple possession.[194] Therefore, it would be treated as a misdemeanor if prosecuted under federal law since possession is so treated, and all three factors would indicate the conviction is a misdemeanor. See § 9.5, infra.
