If there is no current criminal case, and counsel is evaluating the situation to determine whether post-conviction relief can succeed in avoiding adverse immigration consequences of a pre-existing criminal history, counsel should make a list of prior convictions, together with a list of all other criminal offenses suffered by the client. See § 5.17, supra, concerning creation of a criminal and immigration chronology of the client’s situation.
