The preceding chapter outlined the investigation necessary to obtain sufficient information about the criminal and immigration situation of the client to enable immigration counsel to diagnose the problem, and to enable criminal and immigration counsel, working together, to formulate a solution to the immigration problems raised by the current criminal case and previous criminal and immigration history. This chapter will focus on how to develop a strategy to minimize the immigration consequences of a criminal case, in light of the client’s criminal history and the other pertinent facts.
