To determine the deportability of the conviction, it is necessary to ascertain (a) the maximum possible sentence for the offense of conviction, (b) any sentencing rules or guidelines rules that limit the maximum sentence the court may impose within the statutory maximum, (c) any constitutional limitations on sentence, and (d) any limitation on sentence imposed by the plea agreement.
