(C) Sentence Guidelines. Sentencing guidelines or rules must be consulted, since they may limit the maximum legal sentence a court may impose for the offense of conviction. If the sentence guidelines prohibit imposing a sentence greater than a given amount of custody, it is possible to argue that a greater sentence may not be imposed for the offense, so the offense would not trigger a ground of deportation that requires that the greater level of custody may be imposed.
