§ 5.26 VI. General Safe Havens

The term “general safe havens” is used to describe safe havens that prevent deportation under all conviction-based grounds of deportation.  Each existing prior conviction and proposed disposition of a criminal case must be checked to determine whether one or more of these generic safe havens is present to provide protection against all grounds of deportation:

 

(A)    United States citizen.  See § 4.5, supra.

(B)    National of the United States.  See § 4.6, supra.

(C)    American Indian born in Canada.  See § 4.7, supra.

(D)    Conviction did not occur after “admission” to the United States.  See § 4.34, supra.

(E)    Conviction is not for a criminal offense.  See § § 4.9 ff., supra.
