Since the motion is made after judgment, a conviction exists for immigration purposes.  Compare discussion in § 5.52, supra.  Therefore, the motion must be made and granted on a ground of legal invalidity that existed at the time the conviction first occurred in order to be effective in eliminating the conviction for immigration purposes.  See § 4.6, supra.

 

Pendency of Post-Conviction Relief.  The pendency of this request for post-conviction relief does not destroy the finality of the conviction.[222]
