§ 5.26 5. Negotiating a Better Result On Appeal

It is possible to attempt to negotiate a reversal of the conviction or sentence while the appeal is pending.  This is quite difficult, however, since it means obtaining the agreement of the prosecution to reverse the conviction or sentence, and to remand the matter for implementation of the new plea agreement.  This also requires the agreement of the court of appeals, which may not be forthcoming.  It may be worthwhile, however, to attempt this because of the fact that, generally speaking, only 5% of criminal appeals result in reversal of conviction.
