In the Ninth Circuit, state, federal, or foreign rehabilitative relief works to eliminate first convictions of simple possession of any controlled substance, and certain equivalent or more minor offenses that are not violations of federal controlled substances law, where the defendant would have been eligible for relief under the Federal First Offender Act if the case had been prosecuted in federal court.
