(A) Other Misdemeanor Drug Trafficking Convictions. It is possible to argue that convictions of offenses that meet either the common-sense definition of drug trafficking or the test of 18 U.S.C. § 924(c) do not fall within the aggravated felony definition if they are misdemeanors.[289]

Apr. 11, 2003) (unpublished) (New York misdemeanor conviction of criminal sale of marijuana in the fourth degree, in violation of New York Penal Law § 221.40, does not constitute an illicit trafficking aggravated felony under 8 U.S.C. § 1101(a)(43)(B), because it is a misdemeanor).
