§ 7.214 M. Public Safety Conduct

Any noncitizen is deportable who “has engaged, is engaged, or at any time after admission engages in” any criminal activity which endangers public safety or national security.[1468]  NOTE: No conviction is required to establish this ground of deportation. The BIA in an unpublished opinion held that the public safety deportation ground should be read to mean activity contrary to national security, not simply criminal activity.[1469]
