§ 7.182 B. Failure to File Change of Address Conduct

A noncitizen required to register with the immigration authorities[1269] is deportable if s/he fails to comply with INA § 265, 8 U.S.C. § 1305, which requires him or her to notify the INS of a change of address within 10 days.[1270]  NOTE: A conviction is not required for this ground of deportation.  “Generally, however, an alien’s failure to comply with the § 265 reporting requirements will not be the sole basis for the initiation of removal proceedings or prosecution. INS Operations Instructions (OI) 265.1(a) . . . .”[1271]

 

            This deportation ground does not associate deportability with any particular entry, so deportability may be based upon acts occurring prior to the last entry into the United States, since a departure from the United States does not necessarily eliminate a ground of deportability resulting from an act committed in the United States prior to the departure.[1272]  Once a noncitizen has been removed as a result of this ground of deportation, s/he cannot be removed again on the same ground for the same acts after having received permission to reapply for admission and returning to the United States.[1273]  If a noncitizen has been removed based on another ground of deportation, s/he is not subject to removal for failure to provide a change of address or falsification of documents[1274] after lawful re-entry simply because the conduct would have rendered him or her deportable under that provision prior to removal.[1275]
