(B) Warning: Many Dispositions that are not Convictions Under State Law Constitute Damaging Convictions Under Federal Immigration Law. When negotiating a non-criminal disposition, defense counsel must ensure that it does not in fact constitute a conviction under immigration law. See § 7.10, supra. In addition, counsel must also ensure it does not entail an admission of facts that might trigger conduct-based immigration consequences that do not require a conviction. See § 7.7, supra.
