Negotiating with the prosecution is very similar to other negotiations.  Defense counsel must convince the prosecutor that s/he will not get what s/he wants or the inconvenience involved is more than s/he is willing to pay.  Only then will the prosecutor agree to settle for less than s/he wants.[37]
