(A)  Relationship Between Probation Violation Proceedings and New Criminal Prosecutions.   Many times, when the defendant has violated probation, the conduct that violated probation may also constitute a new criminal offense.  This opens the possibility that the client could be charged with a new crime in a new criminal case, and the same conduct could also be alleged as a violation of probation on the original criminal case.  The interplay between these two cases offers scope for negotiating immigration harmless dispositions.
