(F) Winning On Habeas Before District or Circuit Court. If the jurisdiction limitations restricting petition for review jurisdiction in the court of appeals apply, the client can seek habeas corpus relief in the United States District Court, arguing that the criminal disposition does not trigger a ground of deportation. Appeals by both sides from district court decisions in these cases are also swelling the circuit court immigration-related caseloads.
