The DHS is beginning to argue that an argument that a given conviction does not trigger deportation must be made in the immigration courts below or the issue may not be raised in the appellate court. It is therefore important as always never to concede that a disposition triggers deportation, and to make the safe haven arguments from the very beginning of the case.
