(C)  Vacation of Judgment by Extraordinary Writ.  Vacating the judgment on a ground of legal invalidity, that came into existence at the same time as the conviction itself, eliminates any conviction, including conviction for a drug offense, for immigration purposes.  See N. Tooby, Post-Conviction Relief for Immigrants § § 5.72, et seq. (2004).  Habeas corpus procedures applicable to immigration issues are not available to habeas corpus proceedings attacking the validity of a conviction.[342]

Mar. 15, 2007)(dismissing habeas petition that challenged criminal conviction, and had been transferred from district court to court of appeals under REAL ID Act of 2005 § 106 since section 106 does not apply to habeas petitions challenging a criminal conviction).
