(A)  Different Orders Modifying Sentence.  Any effort to avoid immigration consequences of a criminal sentence by an attempt to vacate or reduce the sentence involves three stages: (1) the vacation or reduction of the sentence itself in criminal court, (2) handling the criminal case the second time around so as to minimize the adverse immigration consequences, and (3) obtaining an order reopening and terminating removal proceedings that were based on the previous sentence.  See § § 11.74, et seq., infra.

SENTENCE - SENTENCE IMPOSED
Hernandez v. U.S. Atty Gen., __ F.3d __, 2008 WL 160265 (11th Cir. Jan. 18, 2008) (twelve month suspended sentence, and one year probation, is a sentence imposed of one year, even if probation is later revoked and the defendant required to serve 22 days in jail).
