There are two methods by which a defendant can be protected against the possibility of removal for a qualifying conviction prior to obtaining the state rehabilitative relief that will eliminate its immigration effects: (1) attempting to avoid a final conviction in immigration court, so as to preclude the initiation of removal proceedings based on the conviction until it has become final, and (2) expediting the state rehabilitative relief in criminal court.
