There are two ways in which counsel can attempt to protect a client against removal on account of a conviction that can ultimately be eliminated for immigration purposes through state rehabilitative relief: (1) attempting to obtain a continuance of removal proceedings until state rehabilitative relief can be obtained, and (2) if that is denied, seeking appellate relief from the BIA or Ninth Circuit Court of Appeals.
