§ 6.17 III. Creation of Safe Record of Disposition

Constructing a record of a safe haven disposition involves taking a careful look at each part of the proposed record of conviction, and making sure it does not contribute to the creation of a conviction that triggers a ground of deportation. Certain general principles are followed during this process. See § § 6.18, et seq., infra.
Then, each element of the record of conviction must be constructed so as not to contribute a fact to the record that would bring the conviction within a ground of deportability. See § § 6.23-6.40, infra.
Finally, counsel must gather in criminal court the documentation necessary to establish in immigration court that the conviction does not trigger a ground of deportation. See § § 6.41-6.49, infra.
