(G)  No Juvenile Court Available at Time of Conviction.  If a youthful delinquent was prosecuted in adult court at a time or in a jurisdiction in which local laws did not provide for treating juvenile offenders in juvenile court, the noncitizen will not be considered to have been convicted of a crime if s/he would have been treated as a juvenile offender if prosecuted under current standards.[48]
