(A)

Disqualification from Relief.  A noncitizen is disqualified from eligibility for a number of different forms of immigration relief if s/he has one or more felony convictions.  These include:

 

            (1)  Amnesty (the two Legalization Programs), see N. Tooby & J. Rollin, Criminal Defense of Immigrants § § 24.9-24.11 (2007);

 

            (2)  the Family Unity Program, see N. Tooby & J. Rollin, Criminal Defense of Immigrants § § 24.8 (2007);

            (3)  Political Asylum, see N. Tooby & J. Rollin, Criminal Defense of Immigrants § § 24.18 (2007);

 

            (4)  Restriction on Removal (formerly Withholding of Deportation), see N. Tooby & J. Rollin, Criminal Defense of Immigrants § § 24.31 (2007); and

 

            (5)  Temporary Protected Status (TPS).  See N. Tooby & J. Rollin, Criminal Defense of Immigrants § § 24.25 (2007).

 

If a felony is reduced to a misdemeanor, the one-felony bar to these forms of relief will no longer be triggered.
