(B)

Attempt or conspiracy.  This ground of inadmissibility specifically includes attempt or conspiracy to commit a crime of moral turpitude.  In other contexts, the courts have found this list to be exclusive – other inchoate offenses such as solicitation to commit a CMT are therefore arguably not included.[4]  (This is not true of the CMT grounds of deportation.)[5]

[4] Cf. United States v. Rivera-Sanchez, 247 F.3d 905, 908 (9th Cir. 2001) (solicitation to commit a drug trafficking offense is not an aggravated felony, since aggravated felonies include attempt and conspiracy, not no other inchoate offenses).  See § 9.80, infra.

[5] See § 5.2, infra.
