Oregon law with a maximum term of imprisonment of five years,

be a felony for purposes of INA § 101(a)(43)(B), 8 U.S.C.
§ 1101(a)(43)(B), and therefore an aggravated felony for sentencing
purposes, even though the maximum possible term under the
Oregon sentencing guidelines was 90 days).
