I. & N. Dec. 336 (BIA Apr. 4, 2002) (Massachusetts conviction
of operating a motor vehicle while under the influence of
intoxicating liquor, in violation of Massachusetts General
Laws, chapter 90, § 24(1)(a)(1), is not a felony that, by
its nature, involves a substantial risk that physical force
against the person or property of another may be used in the
course of committing the offense and is therefore not a crime
of violence, so it cannot be an aggravated felony under INA
§ 101(a)(43)(F), 8 U.S.C. 1101(a)(43)(F)), overruling Matter
of Puente-Salazar, 22 I. & N. Dec. 1006 (BIA Sept. 29,
1999), and Matter of Magallanes, 22 I. & N. Dec. 1 (BIA
Mar. 19, 1998).
