United States v. Hernandez-Hernandez, 374 F.3d 808 (9th Cir. June 30, 2004) (statement of facts contained in a motion filed in the criminal case, which was stipulated during plea proceedings to be the factual basis on which the plea was entered, constituted part of the record of conviction and was sufficient to establish that the California felony false imprisonment conviction occurred under the violent portion of the divisible statute, and the conviction therefore constituted a crime of violence aggravated felony conviction, so as to support a 16-level enhancement of sentence for illegal reentry under USSG 2L1.2(b)(1)(A)(ii)).
