The Senate is considering expanding the definition of "crime of violence" contained in 18 U.S.C. 16 to include a felony offense that presents the inherent risk of injury to person or property.  This might make offenses such as drunk driving or negligent child endangerment into crimes of violence, and therefore aggravated felonies, if a sentence of a year or more is imposed.  It is therefore urgent in marginal cases that would be swept into the new definition, if it is passed into law, to avoid a sentence imposed of one year or more if at all possible, or to plead to a different offense that would not fall within even the new proposed "crime of violence" definition. This legislation would also expand the domestic violence deportation ground, which also depends upon the "crime of violence" definition contained in 18 U.S.C. 16.
