5/12-4(a), (b)(1) (1995) ["aggravated battery" in
this case, according to the indictment, occurred when "[a]
person who, in committing a battery, intentionally or knowingly
causes great bodily harm, or permanent disability or disfigurement"
by use of a deadly weapon other than by the discharge of a
firearm], was a "crime of violence" warranting 16-level
enhancement of defendant's sentence for illegal reentry, under
USSG § 2L1.2(b)(1)(A), since "use" of a deadly
weapon to cause bodily harm is sufficient to require use of
force against the person of another, and the indictment was
included in the record of conviction).
